Agreement to Terms

By accessing or using PayItFast's payment processing services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access our Services.

Description of Services

PayItFast provides payment processing services that enable merchants to accept credit card, debit card, and other electronic payments from their customers. Our Services include:

• Payment gateway and processing services
• Merchant account services
• Transaction reporting and analytics
• Fraud detection and prevention tools
• Customer support services

Eligibility

To use our Services, you must:

• Be at least 18 years of age
• Have the legal authority to enter into this agreement
• Operate a legitimate business
• Not be located in a country subject to sanctions
• Not engage in prohibited business activities

Account Registration

To access our Services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

Prohibited Activities

You may not use our Services for:

• Illegal products or services
• Adult content or services
• Gambling (unless properly licensed)
• Weapons or ammunition
• Controlled substances
• Money laundering or terrorist financing
• Fraudulent transactions
• Any activity that violates applicable laws

Fees and Payments

You agree to pay all fees associated with your use of the Services as outlined in your merchant agreement. Fees may include:

• Transaction processing fees
• Monthly service fees
• Chargeback fees
• Setup or integration fees

We reserve the right to modify our fee structure with 30 days' notice.

Settlements

Funds from processed transactions will be deposited into your designated bank account according to your settlement schedule. We may hold funds in cases of suspected fraud, excessive chargebacks, or violation of these Terms.

Chargebacks and Disputes

You are responsible for handling customer disputes and chargebacks. Excessive chargebacks may result in additional fees, holds on your account, or termination of Services.

Security

You agree to:

• Maintain PCI DSS compliance if handling cardholder data
• Use secure connections for all transactions
• Implement appropriate fraud prevention measures
• Report security breaches immediately

Intellectual Property

All content, trademarks, and intellectual property associated with PayItFast remain our exclusive property. You may not use our branding without prior written consent.

Limitation of Liability

To the maximum extent permitted by law, PayItFast shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless PayItFast and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

Termination

Either party may terminate this agreement with 30 days' written notice. We may terminate immediately if you violate these Terms. Upon termination, we will process any pending transactions and settle remaining funds minus any applicable fees or reserves.

Governing Law

These Terms shall be governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of British Columbia.

Changes to Terms

We may modify these Terms at any time. Material changes will be communicated with at least 30 days' notice. Continued use of our Services after changes constitutes acceptance of the modified Terms.
